Official Rules for New MAXXsavings Member Sign Up Butcher Box Event Sweepstakes

NO PURCHASE OR PAYMENT NECESSARY TO ENTER TO WIN. PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.

The FoodMaxx MAXX savings sign-up Butcher Box Sweepstakes (the Sweepstakes) will commence at 12:00:00 AM Pacific Time (“PT”) on April 1, 2025 (“Start Date”) and end at 11:59:59 PM PT on April 31, 2025 (“End Date”). The period between the Start Date and End Date will be referenced to as the (“Sweepstakes Period”).

1. Eligibility:
The sweepstakes is open to only legal residents of California and Nevada who are at least eighteen (18) years of age or older at the time/date of entry. Directors, officers, employees, and agents of Sponsor (as defined herein) and the immediate families of such persons (defined as spouse, child, sibling, parent, son-in-law, daughter-in-law, grandparents, so-called “step” or “half” variations of any preceding individuals, and all descendants and each of their respective spouses, regardless of where they live) and those living in their same households, whether or not related, are ineligible to enter, win or collect prizes in this sweepstakes. The sweepstakes is subject to all applicable federal, state, and local laws and regulations, and ordinances. Existing  FoodMaxx or MAXX savings digital members are not eligible to participate.

2. How to Enter:
1)  Online: To enter this sweepstakes, the entrant must sign up as a new FoodMaxx MAXXsavings digital coupon account member and opt-in to receive marketing emails during the Sweepstakes Period. The sign-up process must be completed by April 31st, 2025. Once the entrant has completed the foregoing, the entrant will have earned one (1) (“Entry”) into the sweepstakes.

2) Phone: To enter the Sweepstakes via the phone method of entry, the entrant must call (800) 692-5710 between 8 am and 5 pm PT and provide the following: name, address, telephone number, email address, home address, date of birth, and nearest FoodMaxx or Maxx Value location. Once the entrant has completed the foregoing, the entrant will have earned one (1) entry (“Phone Entry”) into the Sweepstakes. Phone entries must be received by 5 PM PT on April 31, 2025, to be eligible for entry into the Sweepstakes.

Limit one (1) Entry per person/email address during the Sweepstakes Period. Any person who attempts to participate by using multiple methods of entry, multiple email addresses, or multiple identities may be disqualified by the Sponsor in its sole discretion.

3.  Prize(s) and Approximate Retail Value (“ARV):
There will be fifty-four (54) total winners during the Sweepstakes Period. Each prize will consist of   a Butcher’s Bundle meat box. The winner will choose one of three Maxx Meal options 1) Taco Meat 2) Meal Combo or 3) Variety Pack. The total ARV of each prize is $25.00. Total ARV of all prizes to be awarded during the sweepstakes is $1,350.00. The ARV is subject to change based on availability.

4. Winner Selection and Notification:
The winners will be determined by a random drawing that will be conducted on or around May 5, 2025, from among all eligible Entries. The Potential Winner will be contacted via email and must respond within two (2) days of the notification attempt. Failure to respond to the notification as directed within the stated time will result in the forfeiture of the prize. Up to 3 alternates may be selected. All Entries are subject to verification, confirmation, and compliance with the Official Rules. The odds of winning depend upon the number of eligible entries received during the Entry Period.

6. License to Entry:
By submitting an Entry, you agree to allow your name and likeness to be used in promotional materials and announcements related to the sweepstakes, without further compensation, except where prohibited by law.

7. General Conditions:

• The sweepstakes is void where prohibited by law.
• Participants agree to release and hold harmless Save Mart Supermarkets LLC, its affiliates, and their respective officers, directors, employees, and agents from any liability for damages, losses, or injuries of any kind arising from or in connection with the sweepstakes or acceptance of the prize.
• All federal, state, and local laws and regulations apply.

8. Sponsor:
The sweepstakes is sponsored by Save Mart Supermarkets LLC.

9. Limitation of Liability:

By participating in this sweepstakes, you agree that Save Mart Supermarkets LLC, its affiliates, and their respective officers, directors, employees, and agents (collectively, the “Released Parties”) shall not be liable for any injuries, losses, or damages of any kind, including but not limited to personal injury, death, or property damage, resulting from participation in the sweepstakes or acceptance, possession, use, or misuse of the prize.

In the event of any error, problem, or issue that may affect the sweepstakes or the participation process, the sole and exclusive remedy for any participant affected by such issue will be a replacement entry, if possible. The Released Parties are not responsible for any technical malfunctions, network failures, or other issues that may disrupt or interfere with the sweepstakes or the entrant’s ability to participate, including but not limited to problems related to computer systems, hardware, software, or internet connectivity.

By entering, you agree to release and hold harmless the Released Parties from any and all claims, demands, or causes of action arising out of or related to participation in the sweepstakes or acceptance of the prize.

10. Class Action Waiver:

By participating in this sweepstakes, you agree that any disputes or claims arising out of or related to the sweepstakes or these Official Rules will be resolved individually, without resorting to any form of class action, collective action, or representative action.

You agree that they will not bring, join, or participate in any class action or collective proceeding involving any dispute or claim related to the sweepstakes. Any disputes or claims must be resolved solely in an individual capacity through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in California, and will be conducted by a single arbitrator. The decision of the arbitrator shall be final and binding on all parties.

By participating, you acknowledge that they have read, understood, and agreed to these terms.
